ACCESS TO JUSTICE AND MEDIATION AS A PARADIGM OF SOCIAL PACIFICATION: ADVANCES, CHALLENGES AND PROCEDURAL EFFECTIVENESS

Abstract

The present study analyzes the institute of mediation as a self-compositional and humanized means of conflict resolution in the context of the Brazilian multidoor system, investigating its normative advances and structural obstacles. In view of the accelerated modernization of the Judiciary, the research examines the impacts of digital transformation on access to justice, with a special focus on the challenges brought by artificial intelligence systems, the risks of reproduction of algorithmic biases, and the need for institutional governance established by Resolution No. 615/2025 of the CNJ. Through a critical-analytical bibliographic and documentary review, the quantitative indicators of conciliation are confronted with the need to preserve the human and dialogical dimension of conflicts. The results demonstrate that, although Online Dispute Resolution (ODR) technology and platforms offer speed, their full effectiveness depends on a balanced integration that reconciles technological innovation with digital inclusion and human supervision. It is concluded that the consolidation of a true culture of peace requires the strengthening of the interdisciplinary training of mediators and ethical governance that prevents the excessive mechanization of justice.
