CRIMES OF RACISM AND APPLICATION OF BRAZILIAN LAW

Abstract

Racism constitutes a form of oppression based on racial or ethnic criteria, sustaining the false notion of superiority among groups and generating structural impacts across various areas of social life. This study aimed to analyze racist crimes and the application of Brazilian legislation aimed at their repression. A qualitative approach was adopted, based on bibliographic review of legal doctrines, scientific articles, legislation, and case law, using sources such as Scielo and Google Scholar, within the period from 2018 to 2025. The results indicate that, although Brazil has a significant normative framework to combat racism, its effectiveness depends on deep institutional changes, training of legal professionals, and a critical stance from the Judiciary. The study concludes that antiracist legislation, although necessary, is not sufficient on its own, making it essential to articulate legal norms, affirmative actions, and cultural transformation to effectively confront racial discrimination.
