This article analyzes the application of the theory of structural processes in resolving complex disputes in public health in the State of Tocantins. It starts from the premise that the intense judicialization of the right to health reveals the exhaustion of the traditional civil procedural model, based on individual claims and isolated decisions, which are incapable of addressing structural failures. It analyses the Public Civil Action N. 0014520-46.2015.8.27.2706, which exposed the collapse of urology services at the Regional Hospital of Araguaína. It concludes that the structural process stands out as a promising approach for restructuring public policies, enabling the adoption of progressive measures aimed at ensuring the effectiveness of the right to health.
