LEGAL UNCERTAINTY AND EXCESSIVE JUDICIALIZATION

Abstract

The phenomenon of legal uncertainty and excessive judicialization poses several challenges to the contemporary legal system. The overload of the judicial system, resulting from the increased volume of cases, contributes to delays in trials and court congestion, impairing the efficiency and expediency of justice. Additionally, uncertainty in the interpretation and application of the law leads to disparities among judicial decisions, undermining the trust of citizens and businesses in the legal system. The lack of predictability in judicial decisions hampers planning capacity and may generate uncertainty regarding legal rights and obligations. These negative aspects of legal uncertainty and excessive judicialization represent significant challenges to upholding the rule of law and demand effective measures to promote a more agile, transparent, and consistent administration of justice.
